1. Acceptance of Terms
By accessing, browsing, registering for, or using the TattooDesignPro platform, website, mobile-responsive studio, API, and associated services (collectively, the "Platform" or "Services"), you confirm that you have read, understood, and agreed to be legally bound by these Terms of Use ("Terms") and our Privacy Policy.
If you do not agree to these Terms in full, you must immediately discontinue use of the Services.
2. Eligibility & Age Requirements
The Services are exclusively intended for individuals who are at least 18 years of age or the legal age of majority in your jurisdiction. Due to the adult nature of tattoo artistry and binding financial commitments, individuals under 18 years of age are strictly prohibited from creating accounts, making purchases, or utilizing paid studio generation tools.
3. Platform Services & AI Studio Blueprint Scope
TattooDesignPro provides automated artificial intelligence tattoo concept generation, client-side 300 DPI thermal stencil extraction, 3D/AR virtual placement try-ons, and downloadable consultation briefs.
You acknowledge and understand that:
- Generative outputs are produced algorithmically using machine-learning neural models and visual edge-detection filters.
- Generated artwork constitutes a digital visual blueprint and starting concept. It may require line-weight adjustment, anatomical warping, or stencil tracing by a licensed tattoo practitioner prior to needle application.
- TattooDesignPro does not guarantee that every output will be tattooable on all skin tones or body areas without professional artist adaptation.
4. Intellectual Property & Commercial Licensing
A. Ownership of Generated Output
As between you and TattooDesignPro, subject to your active compliance with these Terms and payment of applicable plan fees or credit packs, you own all rights, title, and commercial interest in the custom tattoo designs, line art stencils, and consultation briefs you generate through the platform.
B. Permitted Commercial Uses
- Tattooing the design onto paying human clients in professional tattoo studios or private suites.
- Transferring stencils onto thermal transfer paper (Spirit, OZER, Phomemo, Brother PocketJet) for physical tattooing.
- Displaying generated designs on flash boards, studio portfolio books, or digital shop displays.
- Printing and selling physical art prints, clothing, and studio merchandise featuring the designs.
C. License to TattooDesignPro
To operate and improve our Services, you grant TattooDesignPro a non-exclusive, worldwide, royalty-free license to host, store, cache, and display your inputs and generated outputs solely for the purpose of delivering the Services to you and operating the platform infrastructure.
5. Prohibited Conduct & Acceptable Use Policy
You agree not to use the Services to:
- Generate imagery depicting child sexual abuse material (CSAM), non-consensual sexual content, or severe gore.
- Generate hate speech, defamatory symbols, or imagery intended to harass or intimidate protected groups.
- Infringe upon valid third-party copyrights, trademarks, or trade secrets without proper authorization.
- Reverse engineer, decompile, scrape, or systematically extract models, weights, or database entries from our platform.
- Attempt to bypass rate limits, credit quotas, authentication tokens, or payment gateways.
6. Subscriptions, Credits & Payment Processing
Paid features and generation quotas are billed on a subscription basis (monthly or annual) or through one-time credit bundles:
- Merchant Processor: All payments are securely processed by Stripe, Inc. We do not retain credit card details on our servers.
- Automatic Renewal: Recurring subscriptions automatically renew at the end of each billing cycle unless cancelled prior to renewal via your Billing dashboard.
- Credit Expiration & Quotas: Subscription plan credits refresh according to your billing cycle. Unused credits rollover or expire as detailed in your tier specifications.
- Refunds: All refund requests are governed by our separate Refund Policy.
TattooDesignPro is solely a digital graphic design and stencil generation software tool. We do not provide dermatological guidance, medical advice, or physical tattooing services. Physical tattooing involves piercing the epidermal and dermal skin layers, which carries inherent medical risks including infection, ink allergies, scarring, keloids, granulomas, and bloodborne pathogen transmission.
Clients and practitioners must always verify ink chemistry, maintain autoclave or single-use disposable sterilization protocols, conduct skin patch tests when necessary, and follow certified aftercare procedures. TattooDesignPro disclaims any and all liability related to physical inking procedures or anatomical reactions.
8. Disclaimer of Warranties
THE SERVICES AND ALL GENERATED CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ARTISTIC ACCURACY, OR NON-INFRINGEMENT.
9. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall TattooDesignPro, its directors, employees, or partners be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business goodwill, arising from your access to or use of the Services. In all circumstances, our maximum aggregate liability shall not exceed the amount paid by you to TattooDesignPro during the twelve (12) months preceding the claim.
10. Modifications & Termination
We reserve the right to modify these Terms at any time. When material changes occur, we will update the "Last Reviewed" date and notify active subscribers via email or prominent platform notice. Continued use of the Services after revisions take effect constitutes acceptance of the new Terms.
